El abogado penalista Valentín Merano calificó como una vergüenza el acuerdo que hizo el Ministerio Público con Ramón Emilio Jiménez, ya que a su juicio se estarían invirtiendo los roles, porque aparentemente en el caso Calamar “hay personas imputables, favoritas”.
Dijo que ese acuerdo que se ha hecho en el caso es un verdadero abuso de derecho, un abuso de poder por parte de las autoridades. En el caso Calamar los principales acusados son los exministros José Ramón Peralta, Donald Guerrero y Gonzalo Castillo.
“El asunto no es lo que yo piense, sino lo que dice la norma”, sostuvo.

Dijo “estamos hablando de que tú llegaste a acuerdo con un con un imputado y sin imputar nunca, sin someterlo en el supuesto de que ha ajustado su conducta una norma proscriptiva junto con otras personas”.
Indicó que el segundo supuesto y el más importante, la norma te permite acordar con personas que tengan una mínima participación en el proceso, es decir, una participación accesoria como acicate de la ocurrencia del tipo penal.
¿Para llegar a quién? ¿A los autores materiales o a las personas que tienen mayor nivel de responsabilidad? ¿Cómo tú mides la responsabilidad?
Manifestó que a partir de la pena que recaiga en el supuesto de la determinación de la responsabilidad penal para esta persona, se podría llegar a un acuerdo, no exonerar de la responsabilidad penal.
“Entonces hicieron un acuerdo al revés, tú acordaste con el autor material para llegar a los cómplices por vía de consecuencia”, dijo.
